Terms of Service

Who these terms apply to
These Terms of Service ("Terms") govern your use of muteaistudio.com (the "Site") and any service booked, requested, or purchased through it, operated by Alphacret trading as MUTE AI ("we", "us", "our"). By using the Site, booking a Noise Audit, or engaging us for a project, you agree to these Terms.
What we do
MUTE AI builds human-directed AI content workflows and produces AI-generated visual content for brands. Our services are delivered by human operators using AI systems — we are not an autonomous content generator, and every deliverable is directed, reviewed, and signed off by a person on our team.
Core services include: the Noise Audit (a free diagnostic call), one-time content or workflow builds, and build-and-operate retainers. The specific scope, deliverables, timeline, and price for any paid engagement are set out separately in a proposal or statement of work, which forms part of these Terms once agreed in writing.
The Noise Audit
- — The Noise Audit is a free, no-obligation 15-minute diagnostic call or asynchronous review.
- — Booking a Noise Audit does not create any obligation for you to purchase further services, and does not create any obligation for us to provide a project quote within a specific timeframe.
- — Any recommendations made during a Noise Audit are given in good faith based on the information you provide, and are not a substitute for a full technical or strategic audit.
Paid engagements
Where you engage us for a paid project or retainer, the following applies unless the specific proposal says otherwise:
- — Scope, price, and timeline are as set out in the agreed proposal. Work outside that scope may incur additional cost, to be agreed before it begins.
- — You agree to provide timely feedback, brand assets, and any information reasonably required for us to deliver the work. Delays on your side may extend the delivery timeline.
- — Payment terms are as stated in the proposal. Late payment may result in paused delivery.
- — Either party may terminate an ongoing retainer with 30 days' written notice, unless a different notice period is agreed in the specific contract.
Intellectual property
Once a project is paid for in full, ownership of the specific deliverables produced for you transfers to you, unless the proposal states otherwise.
We retain the right to use general methods, tools, prompt frameworks, and non-client-identifying know-how developed during the engagement for other clients and our own business.
Unless otherwise agreed, we may reference the fact that we worked with you and display non-confidential examples of the work for portfolio and marketing purposes. If you'd prefer we don't, tell us in writing and we won't.
You confirm that any brand assets, product images, or reference material you provide to us are ones you have the right to use.
AI-generated content — what we do and don't guarantee
- — Our content is produced using AI tools directed by human operators. We aim for brand-accurate, campaign-ready output, but AI generation carries inherent variability — we cannot guarantee a specific number of usable outputs from a specific number of attempts.
- — We do not guarantee specific business outcomes resulting from content or workflows we build. Any figures we share (e.g. time saved, hours reduced) are estimates based on the process, not promises of a specific result.
- — You are responsible for final legal, regulatory, and platform-compliance review of any content before you publish it.
Confidentiality
We treat information you share with us as confidential, and won't disclose it to third parties except where necessary to deliver the service or where required by law.
Limitation of liability
To the maximum extent permitted by law, Alphacret's total liability arising from any engagement is limited to the amount paid by you for the specific service giving rise to the claim in the preceding 3 months. We are not liable for indirect or consequential losses, including loss of profit, loss of business opportunity, or reputational harm.
Nothing in these Terms limits liability for fraud, or for any liability that cannot be excluded under applicable law.
Governing law
These Terms are governed by the laws of India, and any dispute is subject to the exclusive jurisdiction of the courts of India, except as set out below.
If you are based in the European Union or United Kingdom, nothing in these Terms restricts any statutory right you have under the mandatory laws of your country of residence that cannot be limited by contract. Where such mandatory local rights conflict with the governing law clause above, the mandatory local right prevails only to the extent required by law.
Changes to these Terms
We may update these Terms as our services evolve. For active paid engagements, the Terms in place when the proposal was signed continue to apply unless both parties agree to a change.
